When is the Interest Legitimate?

A legitimate interest exists only when the interest in the investigation outweighs the personal rights of the individual being investigated. An example: You have hired a new employee; her outward appearance is highly attractive, and her résumé suggests intelligence and competence. After a few weeks or months, the woman resigns and leaves your company. You then attempt to contact her, but she is no longer residing at the address listed in her résumé, and the phone number is no longer current.

Now there are two possibilities: Either you wish to meet the woman because, for example, you intend to pursue a private relationship with her – in this case, however, the personal rights of the former employee take precedence, and the Aaden Detective Agency Leipzig would decline your request, or we would only be authorized to share data with you if the person being sought explicitly consents. Or you determine that the woman was a corporate spy, possibly acting on behalf of a competitor, who has appropriated your internal company data, and you prefer not to involve the police in this matter for reasons of discretion – in this case, your interest in locating the former employee outweighs the personal rights of the perpetrator, and our detectives from Leipzig can act on your behalf.

Naturally, assignments may only be accepted if our Leipzig corporate detectives are not personally involved, as only in this way can we achieve an objective result that will stand up in court. Should any form of conflict of interest arise, we will decline the assignment or – if the situation arises at a later stage – terminate it. We wish to clarify this in advance, while also emphasizing that such a case has not occurred in practice to date.

It goes without saying that the Aaden Corporate Detective Agency Leipzig also fundamentally complies with all legal regulations and requirements. For example, if images are recorded during surveillance, whether as photographs or video recordings, audio recording is always prohibited by law and will therefore not be carried out by us. Likewise, surveillance of the target person in their most private living environment, for example within their residence, is prohibited by law, which is why the Aaden Detective Agency Leipzig will neither install nor use cameras in a target person’s home. Only in this way can the admissibility of evidence in court be ensured.
